Emergency Rule: NBA accused of not fighting enough to protect democracy in Rivers

The leadership of the Nigerian Bar Association (NBA) has been severely criticised for allegedly not putting up enough resistance against the declaration of a state of emergency in Rivers State.
Following a long-drawn political feud, President Bola Tinubu imposed an emergency rule on the oil-rich state and announced the suspension of Governor Siminalayi Fubara, his Deputy, Ngozi Nma Odu, and state House of Assembly members.
Subsequently, he appointed retired Vice Admiral Ibok-Ete Ekwe Ibas as the Sole Administrator for six months.
In a swift reaction, the NBA condemned Tinubu’s pronouncement, describing it as unconstitutional and a dangerous precedent for Nigerian democracy.

However, according to a civic group, the Centre for Constitutional Watch (CCW), the legal body appeared to have become lukewarm since its initial fiery reaction.
NBA accused of not fighting enough to defend democracy
In a statement issued on Saturday, April 12, 2025, and signed by its Executive Director, Dr. Hassan Bello, the Centre criticised the NBA leadership over what it described as a “muted, convenient reaction” to the development in Rivers.
CCW argued that relocating the NBA’s 2025 Annual General Conference from Port Harcourt to Enugu was not a bold enough statement against the “illegal and shameful occupation of power” in Rivers.
According to the body, Nigerians expected the NBA to go beyond changing venues and instead lead a national resistance against the alleged creeping military democracy slowly strangling the nation’s Constitution.

“You cannot applaud a doctor who simply walks away from a dying patient. By merely relocating their conference, the NBA is walking away from the heart of the crisis. Nigerians expected more. They expected resistance. They expected outrage,” Bello stated.
“Rivers State is under siege. The courts are silent. The constitution is being desecrated in broad daylight. Yet, the supposed custodians of the law are making travel plans instead of leading the charge for justice.”
NBA urged to take stronger action

The Centre challenged the NBA to take more tangible action, including declaring a one-month boycott of all courts in Nigeria to signal zero tolerance for the unconstitutional sole administrator model in place in Rivers.
“This is not the time for cautious statements. The NBA should be declaring a national legal crisis. Their silence in the face of tyranny amounts to complicity,” the statement added.
“You do not fight dictatorship by changing venue. You fight dictatorship by taking the fight to the courtrooms, the streets, and the national conscience.
“If lawyers retreat from a constitutional battle, who will stand for Nigeria’s democracy?
“The sole administrator is an aberration. The NBA must pursue this matter to the Supreme Court and lead public interest litigation that nullifies this political atrocity.”
The CCW called on well-meaning civil society organisations, student groups, and professional bodies to demand more from the NBA, insisting that the rule of law cannot survive if those entrusted with its defence choose convenience over courage.

FG plays Nnamdi Kanuâs broadcast, videos in court to establish alleged terrorism charge

The ongoing trial of the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, continued on Wednesday May 7, 2025, at the Federal High Court in Abuja with the Federal government prosecution counsel playing some of the Radio Biafra broadcast and videos made in open court to establish the allegation of terrorism preferred against him. The broadcast and video documents, which were marked as exhibits, were tendered through the 2nd prosecution witness (PW-2), identified as BBB, before Justice James Omotosho of the Federal High Court in Abuja. The recordings were said to have featured statements allegedly made by Kanu during periods of national unrest, including the 2020 EndSARS protests and various security incidents in the South-East. According to reports, in one of the broadcasts, Kanu was reportedly heard lamenting Fulani herders attacks and accusing Nigerian governors of betraying the South-East region. He also reportedly made controversial remarks about prominent political figures, including Imo State Governor Hope Uzodinma and former Rivers Governor Nyesom Wike, now Minister of the Federal Capital Territory (FCT). The content of the broadcasts reportedly ranged from calls for self-defense to direct criticisms of perceived government failures. It was gathered that a key point of contention was the interpretation of the broadcasts, as while the prosecution argued that the statements incited violence and promoted secessionist agendas, Kanus defense team, led by Chief Kanu Agabi (SAN), maintained that the broadcasts were political expressions protected under constitutional rights.Travel guides The prosecutions witness, under examination, confirmed Kanus identity in the videos and attempted to link the broadcasts to violent incidents, including attacks on security facilities. However, when questioned on certain charges, the witness admitted being unaware that some of the said charges had been previously struck out by the court.A notable portion of todays hearing also centered around the 2017 proscription of IPOB. The defense made no objections to the admission of the proscription document but pointed out that the ban was imposed through an ex parte order without IPOBs legal representation. The court was also presented with a letter from the former Attorney General of the Federation directing Kanus arrest, a document which the defence insisted was not initially served to them. Justice Omotosho had earlier insisted that all evidence must be duly served to the defence in the interest of fair hearing.The trial was adjourned to Thursday, May 8, for continuation of the examination of prosecution witnesses. Nigerian national pleads guilty to cyberstalking, other charges related to the s@xual extortion and d3ath of 20-year-old man in US

A Nigerian man, Imoleayo Samuel Aina, aka Alice Dave, 27, entered a plea of guilty before United States District Court Judge Joel H. Slomsky to cyberstalking, interstate threat to injure reputation, receiving proceeds of extortion, money laundering conspiracy, and four counts of wire fraud, in connection with the sexual extortion and d3ath of a 20-year-old man, Jack Sullivan, who committed suicide in the Eastern District of Pennsylvania. United States Attorney David Metcalf announced this in a statement issued by the U.S. Department of Justice on Tuesday, May 6, 2025. Aina and co-defendant Samuel Olasunkanmi Abiodun, 25, were arrested on a complaint and warant in Nigeria, taken into custody by the FBI on July 31, 2024, and extradited to the United States to face charges in this case. They and another Nigerian co-defendant, Afeez Olatunji Adewale, 25, were then charged by indictment in August 2024. Aina is scheduled to be sentenced on August 11 and faces a statutory maximum of lifetime imprisonment. Abiodun pleaded guilty in December to money laundering conspiracy and four counts of wire fraud. He is scheduled to be sentenced on June 10 and faces a statutory maximum of 100 years imprisonment. Adewale has also been charged with money laundering conspiracy and four counts of wire fraud. He remains in Nigeria, pending extradition to the U.S. The case was investigated by the FBI and the Abington Township Police Department and is being prosecuted by Assistant United States Attorney Patrick Brown. Aina and Abiodun were extradited to the Eastern District of Pennsylvania with assistance of the Justice Departments Office of International Affairs, the FBI Legal Attach in Abuja, and the FBI. The support and assistance of Nigerian security authorities was essential to this effort, notably that of Nigerias Attorney General of the Federation and Minister of Justice, the Federal Ministry of Justices International Criminal Justice Cooperation Department, and the Economic and Financial Crimes Commission. Jack Sullivan, a 2021 graduate of Abington Senior High School and Kutztown University sophomore, received a flirtatious Instagram message from a user who called themselves Alice Dave in January 2023. The two exchanged messages, and later intimate photos on Snapchat. Later that night, Alices flirty texts were replaced with threats that if Sullivan didnt send money, she would share the photos with his family, friends, and campus community all u have to do is cooperate with me and I will not expose u, if you block me I will ruin your life, Alice wrote, according to law enforcement records. dont try to act smart I know where you live. Sullivan sent roughly $2,800 but Alice refused to delete the photos. Less than 24 hours after the first message, he walked onto train tracks leading to the Jenkintown SEPTA station. Three minutes later a passing train struck and k!lled him. Originally ruled a suicide, the coroners office in Montgomery County changed the cause of d3ath to homicide following an investigation. Sullivans parents filed a civil lawsuit in December 2023 against the social media companies which own Facebook, Instagram, and Snapchat for failing to remove predatory accounts.
